1. Who this agreement is with

Brevily is operated by Psionic Ventures LLP, a limited liability partnership registered in India. Our LLP identification number, registered address and GST registration are published in the footer of every page on this site. By creating an account, or by using Brevily in any way, you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind it, and "you" means that company.

2. What the service does

Brevily creates short links that redirect to a destination you choose, and reports on the clicks those links receive. Depending on your plan it also provides custom domains, deep links into mobile applications, QR codes, an API and team access. The features available on each plan are described on the pricing page and may change as the product develops; we will not remove a material feature from a paid plan during a period you have already paid for.

3. Your account

You are responsible for everything done through your account, including by people you invite and by API keys you issue. Keep your credentials secret and tell us at help@brevily.com as soon as you suspect they are not. You must give accurate registration details and keep them current. You must be at least 18 years old, or the age of majority where you live, whichever is higher.

4. Your content and your links

You keep all rights in the destinations you link to, the slugs you choose and anything you upload. You grant us only the licence we need to run the service: to store your content, to resolve and serve your links, to fetch a destination in order to check that it works and is not listed as malicious, and to generate previews and QR codes.

You are solely responsible for the destinations you point links at and for having the right to point at them. You must not use Brevily for anything listed in our Acceptable use policy, which forms part of this agreement.

5. Suspension and removal

Short links are a known vector for phishing and malware distribution, and we take that seriously. We may disable an individual link, suspend an account, or both, without prior notice, where we reasonably believe a link breaches the Acceptable use policy or the law, or where a destination is listed on a malware or phishing blocklist we query.

Where we disable a link we will show a page saying it was disabled and how to appeal, to both the visitor and the link's owner. We will tell the account owner by email. If you think we got it wrong, write to help@brevily.com and a person will review it. We do not reassign a disabled link's back-half to anyone else.

6. Fees, taxes and payment

Paid plans are billed monthly in advance through our payment provider. Prices are shown on the pricing page and are exclusive of Goods and Services Tax and any other applicable tax, which is added at the prevailing rate and shown before you pay. You authorise us and our payment provider to charge your chosen payment method for each renewal until you cancel.

We may change prices with at least 30 days' notice by email. A price change takes effect at your next renewal; if you do not accept it, cancel before that date.

Cancellation and refunds are governed by our Refunds and cancellations policy.

7. Availability

We work to keep the redirect path available and fast, and we publish what we measure. We do not promise uninterrupted service, and nothing on this site or in our marketing is a service level agreement unless we have signed one with you separately. We may perform maintenance, and we will avoid doing so at peak times where we reasonably can.

8. Ending the agreement

You may cancel at any time from the console or by writing to help@brevily.com. We may end this agreement on 30 days' notice, or immediately if you materially breach it, if your use exposes us or our other customers to legal or security risk, or if you do not pay.

When a paid plan ends, links on a Brevily domain continue to redirect. Links on your own domain continue to resolve for 30 days, which is time to move your DNS. You can export your links and their click data as CSV at any time while your account is open, and for 30 days afterwards. After that we delete your data as described in the Privacy notice.

9. Warranties and what we do not promise

Brevily is provided "as is". To the fullest extent permitted by law we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

In particular: our destination checks tell you what we knew at the time we looked. A destination can change after we check it. A link that has passed our checks is not a statement that the page it points to is safe, lawful or accurate, and you must not present it as one.

10. Limitation of liability

Nothing in this agreement excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence.

Subject to that, neither party is liable to the other for loss of profit, loss of revenue, loss of business, loss of goodwill, or any indirect or consequential loss, however arising.

Subject to that, our total aggregate liability arising out of or in connection with this agreement, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of (a) the total fees you paid us in the twelve months immediately before the event giving rise to the claim, and (b) five thousand rupees (INR 5,000).

You accept that these limits are reasonable given the price of the service, and that the price reflects them.

11. Indemnity

You will indemnify us and hold us harmless against any claim, demand, loss, liability, fine or reasonable cost (including legal fees) brought by a third party and arising from the destinations you link to, the content you publish through Brevily, your breach of this agreement or of the Acceptable use policy, or your infringement of anyone's rights.

12. Data protection

Each party will comply with applicable data protection law, including India's Digital Personal Data Protection Act, 2023, and, where it applies to your use, the UK and EU General Data Protection Regulations. How we handle personal data is set out in the Privacy notice. Where we process personal data on your behalf as a processor, our Data processing terms apply.

13. Changes to these terms

We may change these terms. If a change is material we will give you at least 30 days' notice by email or in the console before it takes effect. Continuing to use Brevily after that date means you accept the change. If you do not, cancel before it takes effect.

14. Governing law and disputes

This agreement is governed by the laws of India. The courts at Bangalore, Karnataka have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Before starting proceedings, please write to help@brevily.com and give us 30 days to resolve the matter. Most things are a misunderstanding and can be fixed in a day.

15. General

If any clause is found unenforceable, the rest stands. A delay in enforcing a right is not a waiver of it. You may not assign this agreement without our written consent; we may assign it to a successor of our business on notice to you. This agreement, together with the policies it refers to, is the entire agreement between us on its subject matter.
